Chapter 7 Bankruptcy Qualifications: The Means Test

Under the new bankruptcy law, a two-part income and budget analysis is used to determine whether you are eligible to file for a Chapter 7 bankruptcy.

  • Median income test: Under the "median income" test, your average household income for 6 months will be compared with that of other people in your state. If your income is below the means test average, you likely qualify for Chapter 7 bankruptcy. However, your disposable income after all allowable deductions is determinative.

  • Means test: If your income exceeds the average median income of others in your state, you will be submitted to a secondary analysis called the "means test." In the means test you will be limited to standard deductions for certain expenses, based on the size of your family.
